1. Application

• i. This Privacy Policy is applicable to personally identifiable information collected,any other sensitive data, entered, processed, stored and used in connection with https://sonypicturesindia.com/ and https://majorthemovie.sonypicturesindia.com/ or via a dedicated application of the said URL, if any, accessible on Users’ (defined below) mobile phones / tablets / other devices connected to the internet ("Site") operated by Sony Pictures Films India Pvt. Ltd. (formerly known as SPE Films India Pvt. Ltd.) (hereinafter referred to as "SPFI"/ "we"/ "us"/"our") having its office at Interface Building 7, 3rd Floor, Off Malad Link Road, Malad (West), Mumbai – 400064, India. This policy is in addition to the Privacy Policy incorporated otherwise on the URL and does not cover any such information collected in any other manner or by any other website offered by SPFI and/or any affiliates that SPFI directly or indirectly owns or controls (collectively, “Affiliates”) or collected by any other company, unless specifically stated. Such information collection may be governed by separate privacy policies or notices. 
• ii. The Site is designed and targeted to Indian audiences and is governed by and operated in accordance with the laws of India. We make no representation that this Site is operated in accordance with the laws or regulations of, or governed by, other nations. By using the Site, you certify that you meet the age and other eligibility requirements for this Site as set forth in our Terms of Use, as applicable. If you do not meet the age and other eligibility requirements, if any, please discontinue using the Site immediately as your continued use of the Site indicates that you are agreeing to the collection, use, disclosure, management and storage of your Information as described in this Privacy Policy.
• iii. If you are located outside of India, you use this Site at your own risk and initiative and you, not SPFI, are responsible for compliance with any applicable local and national laws. Please be aware that any Personal Information and Other Information you provide to us or we obtain as a result of your use of this Site will be collected in India and shall be subject to Indian law. By using this Site and/or providing us with your Personal Information and Other Information, you (a) consent to the transfer and/or processing of any Information to and in India, (b) acknowledge that Indian law may provide a different standard of protection for personal data than the laws of your location and (c) understand that we will collect, transfer, store, process and/or deal with your Information in accordance with this Privacy Policy and Indian law. Consequently, to the full extent permitted by law, you hereby waive any claims relating to the processing of your Personal Information or Other Information in accordance with this Privacy Policy that may arise under the laws and regulations that apply to you in or of any other country or jurisdiction.

2. Types of Information collected

• 2.1. Information You Provide
  In order to use the Site and the services offered, Users ("User" / "You") may be required to create an account with SPFI ("SPFI Account"). Creating the SPFI Account may require the User to provide inter alia the following personal information associated with the User, including but not limited to his / her / their name; gender; residential address, including city / state / province (if applicable), postal code, country, and region; phone and mobile number, e-mail address; preferred language; and login name and password ("Personal Information").
• 2.2. Automatic Information Collection
  (i) SPFI may use a variety of technologies that automatically or passively collect information about how the Site is accessed and used ("Usage Information"). Usage Information may consist inter alia of the following data about your visit to the Site: content viewed, date and time of view, content listed on watch-later-list; followed content; favored content; access type depending on the model of services described hereinabove, number of website hits, type of computer operating system including the type of internet browser and internet service provider. Usage Information is generally nonidentifying in nature, but SPFI may associate the same with other information collected and hence treats it as Personal Information.
  
  (ii) SPFI also may automatically collect your IP address or other unique identifier for the computer, mobile device, technology or other device (collectively, "Device") which you use to access the Site. A unique identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by this number ("Device Identifier"). Some mobile service providers may also provide us with the physical location of the Device used to access the Site.
• 2.3. Cookies and Web Beacons
  (i) By using the Site, you consent to our cookies, which are basically files that web servers place on your Device. The use of cookies on the Site allows you to enjoy more seamless visits to the Site and more accurately measures your behavior on it.   (ii) SPFI may also use Web Beacons in combination with cookies to understand how you interact with Site. Web Beacons are typically transparent graphic images that are placed on the Site or in an email and allows the Site to measure your actions in opening the page that contains the Web Beacon.
  
  (iii) SPFI may also use other asynchronous methods and / or technology in combination with / without other tracking technologies to understand a User’s
  
  (iv) This Site may also use a web analytics service provider who may use an Analytics Tool. Analytics Tools use cookies, text files, SDKs, APIs that are stored on your Device and allow an analysis of your use of the Site. The information generated by the cookie about your use of the Site, including the IP address, may be transferred to and stored on a server of analytics service provider, which may not be located within India and who may use such information, to analyze your use of the Site, to create reports about the web site activities and to provide further services associated with the use of the Site. Furthermore, it may transfer such information to third parties, to the extent legally required or if such third parties process the data on behalf of the service provider. By using the Site, you consent to such transfer of Personal Information including storage on servers not located within India.
• 2.4 SPFI advises you to be careful about phishing emails and advises you to be cognizant of the fact that identity theft can be committed through e-mail or other means, such as regular mail, fax or telephone by phishing. Phishing is when you receive authentic-looking messages, but in reality, it is sent by imposters using similar looking email addresses to obtain Personal Information especially personally sensitive data such as financial information. Please remember that none of the payment gateways on the Site send e-mails that ask for unsolicited confidential information such as personally sensitive financial information by email and do not conduct or approve financial transactions over email. WE DO NOT SEND EMAILS ASKING YOU TO PROVIDE OR CONFIRM CREDIT CARD NUMBERS OR YOUR USERNAME OR PASSWORD! If you receive such email communication, please forward it immediately to by sending an electronic communication to SPFI to the SPFI email ID [email protected] with the subject of “Privacy Threat”, and then immediately delete the fraudulent email from your computer.

3. Purpose of collection and usage of personal information

• 3.1 SPFI may use the Personal Information collected for the following purposes, amongst others: (1) process your registration; (2) enable you to visit the Site and enjoy more seamless visits to the Site; (3) enable you to use and receive the services offered on the Site, including e-mail communications informing you about the services and content provided by SPFI through the Site; (4) contact you with regard to your SPFI Account and in connection with any services or content subscribed through the Site; (5) tailor content and offers to you according to your preferences relating to business interests; (6) improve and enhance the Site according to your preferences relating to business interests and relating to website usage; (7) Saving your password or other Personal Information, so you don’t have to re-enter it each time you visit the Site, and (8) other purposes specifically disclosed to you prior to the collection of your Personal Information or otherwise with your consent.   (ii) study traffic patterns in order to improve website performance, to customize the user experience, and to better match the users' interests and preferences;
  
  (iii) keep track of preferences you specify while you are using SPFI’s content or services;
  
  (iv) recommendations of content to the user, based on usage;
  
  (v) support security measures, such as requiring re-login into the Site after a
  
  (vi) certain amount of time has elapsed;
  
  (vii) when you login to the Site, cookies can also be used to save the username so that we can process the saved login information and quickly log you into the Site;

5. SPFI’S COMMITMENT TO PRIVACY AND CHOICES

• 5.1. SPFI respects your privacy and is committed to protecting the personally identifiable information that you provide, in connection with your use of its Site. SPFI takes reasonable and appropriate precautions to protect your personally identifiable information from unauthorized disclosure and to prevent possible security breaches.
• 5.2. These transactional account messages will not be stopped even after you choose to opt-out from marketing communications. In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Site. SPFI is under no obligation to store such Personal Information indefinitely and hereby expressly disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it may not be possible to completely remove or delete all of your Personal Information from our databases in order to effectuate any opt-out preferences you have made due to technical concerns with data backup and contingency support.
• 5.4. SPFI incorporates commercially reasonable safeguards to help protect and secure your Personal Information. However, in light of the fact that electronic data can be intercepted, corrupted, lost or destroyed, please note that SPFI cannot ensure or warrant the security of any data, and your use of the Site is at your own risk.

  You are solely responsible for maintaining the strict confidentiality of your password, if applicable, and for any charges, costs, expenses, damages, liabilities and losses we incur or may suffer as a result of your failure to do so. You, and not SPFI, are solely responsible and liable for the activity, behaviour, use and conduct on the Site under your password (whether used by you or any others who use your password), unless and until you notify us that your password may have been compromised, misappropriated or improperly taken or used by another party. We reserve the right to deny access, use and registration privileges to any user, including without limitation, a registered user, of any services, features or functions of the Site if we believe there is a question about the identity of the person trying to access the user’s account or any services, features or functions.
